On July 8, 2010, the St. Regis Mohawk Tribe (the “Tribe”) issued a press release announcing that it is ending its exclusive negotiations with Empire Resorts, Inc. (the “Company”) and is pursing alternative sites and options for off-reservation gaming in the Catskills region of the State of New York. The full text of such release is filed as Exhibit 99.1 hereto and incorporated herein by reference.
On July 8, 2010, the Company issued a press release in response to the Tribe’s announcement, a copy of which is attached hereto as Exhibit 99.2 and is incorporated herein by reference.
